Terms and Conditions

 This is the terms and conditions notice of Alison Sumner. The terms in this notice relate to when you engage Alison Sumner to perform a live performance or session recording.

Performance times

Performance times to be agreed between Alison Sumner and the Client in advance.

Alison Sumner has no responsibility for performing beyond the agreed performance times in writing / email due to factors outside of Alison Sumner’s control, including event scheduling slippages or mishaps.

Payment Terms for all private events

An immediate deposit payment is required in order to secure your date with Alison Sumner (all payments are non refundable and non transferable). The Purchaser agrees full settlement will be received at least one month prior to the event date.

Cancellation of any events will be charged as follows:

  • More than 1 year prior to event – no further payments beyond those received
  • Between 6 months and 1 year prior to event – 35% of the remaining balance
  • Between 2 months and 6 months prior to event – 50% of the remaining balance
  • Within 2 months of event – 100% of the remaining balance

Cancellation by the client

a) Where a booking was made for a private event without a contract, but via an invoice

Should your event be cancelled or rescheduled due to illness, accidents, riots, strikes, terrorist threats, epidemics, pandemics, acts of God, or any other legitimate conditions beyond Alison Sumner’s control, full payment will still be required as per the Payment Terms above. It is the Purchaser’s responsibility to have appropriate insurance planning in place. Alison Sumner can accept no financial losses when they are not responsible for said scenarios.

b) Where a written, signed contract exists

Any cancellation by the Client must be given in writing by emailing Alison Sumner at ali@alison-sumner.com If cancellation occurs, the Client accepts liability of cancellation of fees on a sliding scale – to be found in the individual contract.

Client changes to the original brief

Further to Alison Sumner and the Client entering into an agreement, via a deposit paid by the Client or a signed Contract, the Client may not change the brief. For example, if Alison Sumner has been booked to play a solo performance at a Wedding Ceremony, the client may not change the brief that requires Alison to perform with another singer, or performer. In such cases, the following will happen:

a) The Client will need to retract the change requested to the brief and instead the original brief shall be followed.

b) Should the client insist on the change request, Alison Sumner will retain the deposit – or the full payment if the balance payment has been made – and cancel the booking.

Performing outside

a) The weather must be dry, with no rain at the time of setting up and with no rain forecast.

b) The outside air temperature must be at a minimum of 15 degrees Celsius.

Safe working conditions

The Purchaser shall provide Alison Sumner with safe and appropriate working conditions. This includes a 2 metres x 2 metres area for setup, space for setting up speakers. Alison Sumner also requires access to a reliable power source.

Illness or accident of the Performer

In the event of illness or accident, resulting in Alison Sumner being unable to fulfil the engagement, Alison Sumner will use best endeavours to secure a replacement that is equally highly skilled, competent and able to carry out the performance according to the Client’s brief. Should such endeavours not be successful, Alison Sumner will fully refund any and all payments made by the Client to Alison Sumner in relation to the event.

The purchaser agrees that in all circumstances, Alison Sumner’s liability shall be exclusively limited to an amount equal to the total booking value and that Alison Sumner shall not be liable for indirect or consequential damages arising from any breach of contract.

Attire

Alison Sumner’s attire is to be smart and neat and in accordance with what has been pre-agreed with the Client. Alison Sumner will conduct herself in a correct and proper manner whilst present at the venue.
